Federal Judge Mandates Freedom of Abrego Garcia from ICE Custody

A court has ruled the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement is without lawful basis.

"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her ruling.

The case stems from a erroneous removal to El Salvador in March, which US authorities later admitted was an error. After his repatriation to the United States to answer human smuggling charges, he was held in immigration custody.

In her order, the judge pointed out that the government lacks a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."

Background of the Legal Challenge

The legal challenge center on conflicting claims. While the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this allegation.

He has also pleaded not guilty to the conspiracy counts, which are part of a separate criminal case in Tennessee.

The court, who was hearing his challenge to removal in a federal court, determined that he must now adhere to the conditions of his release from custody in Tennessee. This order effectively transfers his monitoring to the Tennessee court.
